Sale of 25% of an English Premier League football club

Barlow Robbins’ Corporate Team has advised the owner of AFC Bournemouth on the sale of 25% of the club to PEAK6 Investments, a Chicago-based investment firm.

The sale received national press attention and came to Barlow Robbins given the close working relationship developed over several years between Barlow Robbins and the seller.

Having experienced a difficult start to life in the Premier League, the parties hope that the sale will help to ensure Bournemouth’s continuing presence in the league, with club chairman Jeff Mostyn reporting:

“The club is confident this partnership will further strengthen its ability to compete with the very best, and provide a platform to establish itself as a long-term Premier League club.”

Matt Hulsizer, co-founder of PEAK6, together with Jay Coppoletta, PEAK6’s in-house lawyer, will join the club’s board, adding their experience and a further international element to the club. Otherwise the board will remain unchanged.

The culmination of some 15 months of talks between the parties, the sale of a Premier League club to a private equity firm rather than an individual, family or the public through the stock market was a first for the league and something Barlow Robbins was delighted to be a part of.

The transaction was led by Mark Lucas, with the assistance of Graham Wilson and Helen Archibald (Commercial Property - Partners), Nitzan Cohen (Tax) and Matthew Devine (then a Trainee Solicitor).

The buyer was advised by Pinsent Masons in a team led by Trevor Watkins and James Earl.
