When is a Package Tour Not a Package Tour?
We often hear about the problems people have encountered on package tours. It is important to know what is and what is not a package tour, for the purposes of working out who is responsible if things go badly wrong.
Fortunately, a judgment of the European Court has provided a definition of what constitutes a package tour when ruling on a case in which a family sought compensation for a Club Med holiday ruined by a wasp infestation.
Under European law, a package tour is one where there are ‘tourist services’ sold at an inclusive price including two or more of transport, accommodation or ‘other services’. These must be arranged at the time of the original holiday purchase. This definition excludes holidays in which the hotel and flights are booked separately.
