We have considerable experience in forming charities. Usually we will start by explaining to the proposed trustees the advantages and disadvantages of the different legal structures available to charities and advising on the form and structure which best suits their needs.
We will also advise on the proposed objects to ensure they are charitable by law and that the “public benefit” test is met. Recent changes to charity law in this respect will be explained and how they impact on your proposals.
We will guide proposed trustees through the whole process, preparing a trust deed or memorandum and articles of association and forming a company limited by guarantee or preparing the documentation for the new charitable incorporated organisation, and applying to the Charity Commission for registration.
After formation, we are able to assist the trustees with the running of the charity, if required, providing a fully company secretarial and administration service or advice and guidance on governance issues generally.
