The Claimant was injured whilst employed as a yard person and whilst walking to the front of his vehicle to unload it, he tripped and fell over an uneven surface covered in pot holes. The Defendants allege that he had injured himself whilst jumping backwards from his vehicle. Due to inconsistent witness evidence, we eventually obtained an admission of liability on a 100% basis. Medical evidence was obtained and there were issues on causation about the length of time he was absent from work. The Claimant was made redundant from work and it took him some time to find alternative employment.
The Claimant sustained a fracture to his left ankle requiring him to be on crutches and also undertaking physiotherapy treatment.
