We acted for a gentleman who was involved in a serious car accident. He was the passenger in a car, which hit a tree and rolled over causing him severe injuries: a traumatic brain injury, a spinal fracture and fracture of the sternum.
Whilst recovering remarkably well from the majority of his injuries and being discharged from NHS care relatively quickly, he continued to suffer with difficulties with speech such as stuttering and worsened knee pain. Our client initially dealt with the claim directly with the driver’s insurer however he was recommended to instruct solicitors.
When we took on the case, the first thing we attempted to do was arrange for our client to have his rehabilitation needs assessed. It was identified that our client would benefit from a multi-disciplinary rehabilitation programme to develop his understanding of how to manage his symptoms in order to facilitate maximum recovery and independence.
The Rehabilitation Code exists to encourage both claimant and defendant to work together and implement such recommendations at early stages of the case to ensure that the injured person makes the best and quickest recovery. We had to work particularly hard in this case to ensure the insurer co-operated with us and eventually, a case manager was appointed for our client.
Our client was assessed by occupational therapists, physiotherapists, speech and language therapists and psychiatrists who worked with him to manage his symptoms. When our client’s injuries were at a level that could be adequately assessed, we settled our client’s case with a lump sum compensation payment that should allow for all his future needs, as well as compensate him for the huge impact the accident had on his life. We are hopeful that our client continues to make improvements and put the accident behind him.
