Divorce and separation touches the lives of those who lack capacity, perhaps through traumatic injury, and who are acting by Attorneys and Deputies appointed by the Court of Protection. As an Attorney or a Deputy for an incapacitated person you may become embroiled in family matters.
This may seem a daunting task, but help is at hand from our Court of Protection team. We have experience both in acting as Attorneys and Deputies for people getting divorced who lack capacity and advising Attorneys and Deputies dealing with family law matters on behalf of a person who lacks capacity.
